These are the terms and conditions on which we supply products to you. Before you submit your order with us, please carefully read these terms.
These terms and conditions were last updated in Nov21. We may update these terms and conditions from time to time, so please check back regularly to ensure you have the most current version.
When you confirm your order you agree to the terms and conditions outlined in the contractual agreement, and these terms have been attached, you are agreeing to the terms and conditions contained herein. If you do not agree to these terms and conditions, please do not proceed to make a hire from us.
Acceptance of your order will take place when we confirm in writing by issuing a receipt/invoice, at which point a contract will come into existence between you and Ivory Belle. Until this time, there is no legally binding relationship between you and Ivory Belle. You will receive order confirmation with order reference number which should be used in all hire correspondence.
We offer a selection of Wedding Gowns for hire.
We also offer the following additional services:
· Personal fitting Service at our hire boutique located in Walton on Thames.
If you would like Ivory Belle to alter a garment for you, we will liaise with you to confirm the price. Once the specification has been approved, we will alter the garment for you. It is important that you understand that, provided we have followed the specifications agreed between you and us, the garment cannot be rejected.
Further, since the garment will have been bespoke fitted to your requirements, the usual consumer legislation does not apply. This means that, unless the garment is faulty or not what you ordered, you are not entitled to cancel the order because you change your mind.
Products may vary slightly from the pictures, which is why we recommend our professional fitting service. The images of the products on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device’s display of the colours accurately reflects the colour of the products. Your product may vary slightly from those images.
PURCHASE OF SAMPLES
We also offer for sale items/garments which are no longer required for our standard hire service. By purchasing a sample item, you understand that the item/garment may not be in perfect condition; however, you will still be protected by consumer legislation. This means that you may return the item/garment for a refund, within 14 days of the date of purchase, although you will be liable to pay for the return postage.
The terms for these services may differ from the terms for our standard rental service as outlined in these terms and conditions and we will draw your attention to these.
PRICE AND PAYMENT
The price of the rental will be the price indicated on the order pages when you place your order. We take reasonable care to ensure that the price of the garment advised to you is correct.
It is always possible that, despite our reasonable efforts, some of the garments we rent may be incorrectly priced. We will normally check prices before accepting your order so that, where the garment’s correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the garment’s correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order.
We use Barclaycard to process our payments and therefore accept almost all major credit and debit cards. You will be required to pay 50% of the garment hire at the point of reservation and the balance payable on collection.
Additionally on collection, we will take a deposit for the retail value of the dress, this will be charged to your card. In the event of none return or irreparable damage, we reserve the right to withhold full payment. Heavy soiling may incur an additional surcharge.
By using Barclaycard as a payment method, you authorise Barclaycard to store your card details in case we need to recharge a card for associated fees, e.g. late fines. loss or irreparable damage.
As noted above, the rental period commences from when you or a third party carrier nominated by you collect your garment(s) and shall continue until the garment/s are returned to our boutique..
Under our standard rental service, the maximum rental period is 7 days unless otherwise agreed. Late return fees are charged according to the following structure:
If you pay Ivory Belle an amount equal to 100% of the recommended retail value (as stated on the product page) in late fees, and you still have the garment(s)item in your possession, then the garment is yours to keep.
The rented garments are , and will at all times, remain the absolute property of Ivory Belle. You accept full responsibility for the safekeeping of the garments once the gown has been handed over.
DAMAGES & THEFT
You are solely responsible for the garment(s)you have rented, and are therefore liable for any damage or loss that occurs during the rental period.
Regardless of whether you are personally responsible for the damage, you remain liable for the replacement of the garment because, in receipt of the garment, you agree to take responsibility .
In assessing the replaceable value, we will take into account: the demand for the garment, our ability to purchase a replacement, the condition of the garment, and the rental fee that you have already paid.
INSURANCE
If you have taken out your own insurance on your item, then you are likely to be covered for all repairable damages. Examples include, ripped seams, zip breaks and removable stains that require extra attention. Insurance does not cover damages where the garment must be replaced or written off entirely. In these instances, you are liable to pay the replacement garment costs. Damage assessment is at the discretion of the expert Ivory Belle Team. In the rare case that the item needs to be replaced, you will be sent the damaged garment to keep once the replacement costs have been paid.
CANCELLATION
Cancellation by you: Upon confirmation of the hire and payment of the initial 50% deposit, a 14 day cooling off period will commence. During this cooling off period you shall be entitled to a full refund of your deposit should you choose to cancel the hire agreement. Please note that after the initial 14 days from the date of initial deposit payment, the deposit will become non - refundable, and any cancellation after this period will result in the forfeiture of the deposit.
Orders cancelled within 4 weeks of collection are still liable to pay the full hire fee,.
In certain circumstances, we may need to cancel an order before it has been dispatched to you. Said circumstances can include: if the garment ordered has not been returned/or has been returned damaged by a previous customer, or if you have given us cause to be concerned about your suitability to receive future rentals (e.g. frequent late returns, theft or damaged items.)
